FACTS OF THE CASE:

Dr. Iyad al-Sarraj, Director of the Gaza Community Mental Health Program and the Commissioner General of the Palestinian Independent Commission for Citizen's Rights, was released on 26 June 1996.

This had been the third time Dr. al-Sarraj was arrested by the Palestinian Authority. On 18 May 1996, he was arrested, apparently in connection with comments he made to the New York Times, critical of the Palestinian self rule government and its security forces. He was released by order of Mr. Arafat. However, at the time of his release, the Attorney General announced that Dr. al-Sarraj could still be tried on charges of libel, incitement, and harming the public interest.

On 9 June, Dr. al-Sarraj was rearrested and reportedly beaten in custody. Although no reason was given for his arrest, after a search of his office, Dr. al-Sarraj was accused of illegal drug possession, a charge widely believed to be fabricated. Before being released on bail from that allegation, the State Security Court ordered his 15 day detention charging Dr. al-Sarraj with striking a Palestinian police officer, reportedly the same police officer who had beaten him during his detention. Dr. al-Sarraj had no legal notification nor representation for the latter charge. After his release, the Palestinian High Court will consider the legality of the arrest and detention on 1 July.
